Coupons, Vouchers and Savings Programs

Coupons, vouchers, and savings programs offer Bausch + Lomb a way to help reduce costs for patients. Bausch + Lomb may implement these programs by having sales colleagues distribute coupons, vouchers, and savings program cards directly to healthcare professionals. Additionally, these materials may be shared through websites or other direct-to-patient channels, subject to internal approval as outlined below.

These policies are designed to ensure that the distribution of coupons, vouchers, and savings programs is conducted in compliance with all applicable laws and that these offers are not mistaken for inappropriate incentives to encourage the use of Bausch + Lomb products.

Quick Tips:

  • Coupons, Vouchers and Savings Programs (collectively, “Coupon programs”) require appropriate advance approvals through Bausch + Lomb’s promotional review process.
  • Coupon programs, like samples, must not be used to circumvent price reporting obligations.
  • Vouchers for products cannot be offered contingent upon prescribing any quantity beyond that covered by the Voucher (no quid pro quo).
  • It is not permissible for Coupons and Savings Programs to be used with government health insurance plans, including fee-for-service, managed Medicare and Medicaid and the VA.

Review of Program and Material

All coupons, vouchers, and Savings Programs must undergo review and receive approval from the Legal, Compliance, and Pricing Departments. Any published materials require proper authorization through Bausch + Lomb’s promotional review process.

Specific Program Requirements

The following guidelines apply to all Coupons, Vouchers and Savings Programs:

  • These offers cannot be contingent on prescribing quantities beyond what the voucher covers or on prescribing any product not earned through the voucher.
  • All relevant materials must clearly state that the product is complimentary, provided at no cost, not intended for resale, and must not be billed to any third-party payer.
  • Receiving products through these programs does not obligate the patient or healthcare provider to purchase, order, or prescribe the product in the future.
  • Coupons, vouchers, or savings programs cannot replace discounts provided to customers.
  • These programs must not be used as incentives or rewards for prescribing Bausch + Lomb products.
  • Improper use of coupons, vouchers, or savings programs can affect “best price” reporting, underscoring the importance of proper distribution.
  • Sales colleagues may only distribute coupons, vouchers, and savings programs to healthcare professionals practicing in specialties consistent with the approved product indications.
  • Assistance through these programs must be designed to comply with the safeguards recommended by the Office of Inspector General (OIG).
  • Coupons and savings programs must exclude beneficiaries of federal healthcare programs and implement rigorous screening processes to prevent their participation. Terms and conditions should follow templates and instructions provided by Bausch + Lomb’s Legal Department, with any deviations requiring prior legal approval.

Transparency

All coupons, vouchers, and savings programs provided to healthcare professionals for patient use should be tracked in line with Bausch + Lomb guidelines and comply with applicable state and federal laws.
